MEADOWBROOK MEMBERSHIP AGREEMENT

 

Membership

Meadowbrook offers two forms of membership: seasonal memberships and annual memberships. Seasonal memberships consist of the Summer season, which runs from the Saturday of Memorial Day weekend through Labor Day, and the Winter season which begins on the Tuesday after Labor Day and runs through the Friday prior to the next Memorial Day. There is a separate membership fee for each season, which must be paid in full before the start of the applicable season, except that for the Winter season, there is also a monthly payment option. Meadowbrook also has annual memberships, which run for one (1) year from the date a member signs up. Payment can be made in advance or on a monthly basis during the year, but in either event, the annual membership fee must be paid in full. At the end of the first year of membership in the annual plan, members may either pay in advance for the next year or may convert their annual memberships to month-to-month memberships, which will continue in effect until terminated by the member or Meadowbrook under the provisions of this agreement. All monthly fees must be paid in advance by the 15th day of the month prior to the month of membership. A current schedule of membership fees is attached hereto and is made a part hereof. The current fees will change from time-to-time, and all members and new members will be billed based on the then-current fee schedule for seasonal and annual memberships; however, monthly fees for a new annual membership will not increase for the first 12 months of membership.

 

Payment Authorization

All monthly fees due along with any other authorized member charges, such as for payment of purchases made at Meadowbrook, will be collected electronically. All members must provide Electronic Funds Transfer (“EFT”) information in this agreement. Unless payment is made in full when signing this agreement, if you are paying a monthly fee, by signing this agreement, you authorize Meadowbrook to initiate automatic monthly debit entries from your bank account or to charge your credit card for your monthly fees. Your bank account or credit card will be billed on or shortly after the 15th of each month for the monthly fee due for the current month. You further authorize Meadowbrook to electronically debit your bank account or charge your credit card for any past unpaid amounts. By signing this agreement, you authorize Meadowbrook to effect payment for monthly fees and approved member charges for the full term of your membership through EFT via bank draft or credit card. You agree and understand that this payment arrangement will not be terminated by Meadowbrook unless you give Meadowbrook ten (10) days prior written notice before your next billing date by certified mail, return receipt requested, or personal delivery, of your intent to terminate your membership under the termination provisions in this agreement. You agree to provide Meadowbrook with written notice immediately of any changes in your name, address, telephone or cellular phone number or EFT information. Failure to notify Meadowbrook may result in service fees being imposed due to rejected EFT transactions. You agree to pay Meadowbrook for any returned item service fees as a result of such changes or as a result of not having sufficient funds or credit available in your account. If you fail to make any payment when due for any reason, and any payment becomes thirty (30) days past due, Meadowbrook will charge a service fee of $25. In addition, at any time after payment becomes past due, Meadowbrook may suspend or terminate this agreement without notice and take appropriate action to collect the full balance due under this agreement. In such event, you will be responsible for all costs incurred by Meadowbrook in the collection of any past due obligations including court costs and attorneys’ fees up to 15% of the amount due.
 

Notice of Consumer Rights

If Meadowbrook is closed for a month or more, you are entitled to your choice of either an extension of this agreement or a prorated refund, if applicable. If the closing is not due to the fault of Meadowbrook however, Meadowbrook is entitled to choose whether to extend the agreement or to provide a prorated refund. You have the right to cancel this agreement within three (3) days after you receive a copy of this agreement. To cancel this agreement, mail by certified or registered mail, return receipt requested, or hand-deliver a signed and dated written notice, which states that you are canceling this agreement to Meadowbrook at 5700 Cottonworth Avenue, Baltimore, MD 21209. Upon receipt of written notice of cancellation under this paragraph, Meadowbrook will refund to you all monies paid under the contract hereunder. This notice is an integral part of the membership agreement.

Cancellation Policy

Except as provided above, a monthly member who wishes to cancel his or her membership within the first 12 months of this agreement must submit a cancellation request in writing via certified mail or in person to Meadowbrook at least thirty (30) days prior to the member’s next billing date. Any administration fee that has been paid will be forfeited upon cancellation and all outstanding dues and other authorized charges and fees must be paid upon cancellation. Seasonal memberships and Annual memberships paid in full are non-refundable. Cancellations shall be in the sole discretion of Meadowbrook. Cancellations given approval by Meadowbrook will be subject to a termination fee up to $500 if cancellation occurs within the first six (6) months of this agreement, and a $100 termination fee if cancellation occurs thereafter. Month-to-month members may terminate membership at any time for any reason by notifying Meadowbrook in writing via certified mail or in person thirty (30) days prior to the member’s next billing date and paying all outstanding amounts due prior to termination.
 

Disability and Medical Freeze

If a member becomes disabled for at least three (3) months during the membership term, and the disability is confirmed in writing by a physician, the member is entitled to an extension of this agreement. Members requesting a medical freeze must submit a written request for a medical freeze along with documentation from a physician to Meadowbrook via certified mail or in person prior to the start of the freeze. During the term of the freeze, the member will not be billed and will not be permitted to use the facility. The billing freeze is only available if a member cannot physically receive services because of physical disability for a period in excess of three (3) months. Written verification of such physical condition from the physician is required. All freezes must be processed and approved by Meadowbrook prior to freezing. The member is responsible for reactivating his or her membership by providing written notice to Meadowbrook via certified mail or in person. If the member does not provide documentation and management approval is not given prior to the freeze and upon reactivation, the member’s account will be considered delinquent and will be subject to the payment policy terms and fees described in this agreement. Upon reactivation normal monthly billing will continue at the contractual rate. A freeze due to disability extends your membership by the duration of the freeze.
 

Inactive Member Status

Memberships run continuously and no temporary suspensions are allowed under normal circumstances; however, because of travel schedules or extenuating circumstances such as temporary relocation, inactive membership status may be invoked. Upon written submission to Meadowbrook via certified mail or in person thirty (30) days prior to the requested inactive period, a member in good standing may convert to inactive membership status for a maximum of three (3) consecutive months. Inactive membership fees will be 33% of the applicable monthly membership dues, and must be paid monthly by Electronic Funds Transfer via bank check or credit card. Upon reactivation of membership, or automatically after three (3) months, if Meadowbrook is not notified in writing of reactivation via certified mail or in person, normal monthly billing will continue at the then-current rate.
 

Change in Membership Type

The administration fee will be waived for all seasonal members who convert to monthly membership; however, there will be a minimum monthly membership term of nine (9) or twelve (12) months for all such converting members, depending on the type of membership.
 

Waiver of Liability Forms

Use of the facility is contingent upon signing of a waiver of liability which must be completed prior to or at the time of a member’s first visit to Meadowbrook following the processing of the member’s application.
